This form allows former employees to request materials or other intellectual property prepared by the employee within the scope of his or her employment at Duncanville ISD.
Board Policy CY (Legal) states:
"In the case of a work made for hire, the employer or other person for whom the work was prepared is considered the author for purposes of copyright law, and, unless the parties have expressly agreed otherwise in a written instrument signed by them, owns all of the rights comprised in the copyright. 17 U.S.C. 201(b)
A "work made for hire" is:
- A work prepared by an employee within the scope of his or her employment; or
- A work specially ordered or commissioned for use as a contribution to a collective work, as a part of a motion picture or other audiovisual work, as a translation, as a supplementary work, as a compilation, as an instructional text, as a test, as answer material for a test, or as an atlas, if the parties expressly agree in a written instrument signed by them that the work shall be considered a work made for hire."
Board Policy CY (Local) states:
"Upon the termination of any person's association with the District, all permission to possess, receive, or modify the District's intellectual property shall also immediately terminate. All such persons shall return to the District all intellectual property, including but not limited to any copies, no matter how kept or stored, and whether directly or indirectly possessed by such person."
Intellectual property includes, but is not limited to, "work made for hire" as described in CY (Legal), including copyrights to prepared materials, trademarks, and data.
If the employee wishes to gain access to District materials after leaving the district, the employee may make a request to the Superintendent or designee.
